MITSUBISHI MOTORS CORPORATION ("MMC") may use or introduce content posted on various social media sites ("posted content") on MMC's official social media accounts (Facebook, Twitter, Instagram, etc.), website, etc.
Additionally, MMC may reply to or individually contact the provider of the posted content ("the Customer") through direct messaging, etc. to request permission to use the content. If you consent to MMC's use of posted content, including images, photographs, videos, text, illustrations, and all other content, please reply with the hashtag #agreeMMC.
Your reply will be considered indication of your consent to the items set forth in these UGC Terms and Conditions ("the Terms and Conditions").
Permission for use
The Customer consents to the global use of your posted content on MMC's official social media accounts, website, etc. at MMC's discretion and free of charge.
Additionally, MMC may use, publish, duplicate, distribute, send, adapt, and translate the posted content; create derivative works, advertisements, etc.; combine it with other material; change it; and edit it. By consenting to MMC's use, the Customer agrees that you will not exercise author's moral rights or any other equivalent author's rights to the content.
Personal information
The Customer consents to MMC's acquisition of your personal information for the purpose of using it and disclosing it in relation to use of the posted content based on the Terms and Conditions.
Please note that MMC may name the author when using posted content.
The Customer bears full responsibility for obtaining the consent of other individuals for the use of their personal information when providing it to MMC.
The Customer is requested not to provide your own personal information or that of another individual if you are unable to consent to or have not obtained the individual's consent to MMC's use or disclosure of that personal information.
Warranties
The Customer represents, warrants, and consents to the following:
- The posted content does not violate the terms and conditions of the social media site, etc. to which it was posted or laws and regulations and does not infringe upon any third-party rights.
- The Customer owns all rights related to the posted content or has obtained the appropriate rights or consent from all individuals and organizations that own, manage, or claim rights to said content.
- If a third party is pictured in the posted content, the consent of that third party (or, in the case of a minor, the legal guardian) has been obtained for its use.
- If the Customer is a minor, the consent of the legal guardian has been obtained for providing consent to use images.
- MMC's use of the posted content as set forth in the Terms and Conditions does not infringe upon any third-party copyrights, trademarks, patents, corporate secrets, privacy rights, moral rights, etc., and does not violate any laws and regulations.
Confidentiality
The posted content and the information provided to MMC by the Customer with your consent for its use in accordance with the Terms and Conditions is not deemed confidential, and MMC has no duty of confidentiality with respect to any information included in the information provided to MMC, regardless of the form of said information.
The Customer shall not disclose or leak to a third party the fact that these Terms and Conditions have been agreed to or any technical, sales, or other information of MMC learned in relation to these Terms and Conditions, even after the use or publication of the material in question has ended, without obtaining the prior consent of MMC in writing.
Disclaimer and other notices
- Obtaining permission from the Customer to use your posted content is not a promise that it will be published. The timing of publishing is determined at MMC's discretion. MMC reserves the right to change these Terms and Conditions without prior notice by publishing the changed version in place of the previous version.
- MMC reserves the right to delete the posted content from the media in which it is published without notifying the Customer.
- MMC's brand, website, other services, the content provided thereby, and the content published on MMC's social media accounts ("MMC's intellectual property") is protected by copyright, trademark, and other laws and regulations related to intellectual property. The Customer recognizes and agrees that permitting MMC to use your posted content and/or using or accessing MMC's intellectual property does not convey ownership or any other rights to MMC's information or material.
- It is the Customer's responsibility to handle and resolve any transactions, communications, disputes, etc. arising between the Customer and a third party in relation to permission to use the posted content, and MMC accepts no liability whatsoever for related matters.
- In the event that the Customer violates these Terms and Conditions and causes damages to MMC, the Customer shall compensate MMC for said damages.
- The Customer agrees that MMC opting not to exercise rights or remedies based on these Terms and Conditions or laws and regulations does not constitute a formal waiver thereof and that MMC may still exercise these rights or remedies.
- If any provision of these Terms and Conditions is held to be illegal, invalid, or unenforceable in a certain jurisdiction, all other provisions shall remain unaffected even in that jurisdiction, and the lawfulness, effectiveness, and enforceability of these Terms and Conditions shall be unaffected in other jurisdictions.
Governing law and jurisdiction
These Terms and Conditions are governed by the laws of Japan.
In the event of a dispute arising between the Customer and MMC, the Tokyo District Court shall be the court of first instance with exclusive jurisdiction.
